1. Introduction

These Terms & Conditions ("Terms") govern all yacht charters, boat tours and related services (each a "Charter") booked with GCDB Blue Escape Yachts LTD ("Blue Escape Yachts", "we", "us" or "our") through the website blueescapeyachts.com or any of our booking channels. By making a booking you (the "Client") confirm that you have read, understood and agree to these Terms on behalf of yourself and every guest in your party.

3. Definitions

  • Charter — the yacht charter, boat tour or cruise booked by the Client.
  • Captain — the qualified skipper provided by us who commands the vessel at all times.
  • Vessel — the boat assigned to the Charter (e.g. the Sea Ray SLX 400).
  • Deposit — the non-refundable portion (20% of the total price) that secures the booking.
  • Party — the Client and all guests named on or attending the booking.

4. Bookings

To make a booking you must be at least 18 years old and have the legal capacity to enter into a binding contract. You are responsible for the accuracy of all booking details (date, start time, duration, number of guests and contact information).

A booking is only confirmed once payment has been received and you have received a written booking confirmation from us. We reserve the right to decline or cancel a booking where payment fails, where details are incomplete or inaccurate, or where we reasonably believe the Charter cannot be operated safely or lawfully.

Each Charter carries a maximum of 18 guests. The number of guests must not exceed the figure stated in your confirmation; the Captain may refuse boarding to any person beyond the agreed capacity.

5. Prices & Payment

All prices are quoted in Euro (EUR) and shown per Charter for the selected duration. The full price is charged at the time of booking through our payment provider, Stripe. We do not store your full card details.

Optional extras selected at booking (for example a celebration cake, flowers or a drinks package) are added to the total. Certain inclusions are provided free of charge as stated at the time of booking.

We make every effort to display accurate pricing. In the rare event of an obvious pricing error, we will contact you to confirm the correct price or offer a full refund.

6. Deposit & Cancellation

A non-refundable deposit equal to 20% of the total Charter price secures every booking. Although the full amount is collected at the time of booking, this 20% deposit is non-refundable in all cases of cancellation by the Client.

If you cancel a confirmed booking, you will be refunded the amount paid less the 20% non-refundable deposit (i.e. 80% of the total price is refunded). Refunds are made to the original payment method within a reasonable time.

This cancellation policy does not apply to cancellations made by us for safety or weather reasons — see Section 7, where you are entitled to a free reschedule or a 100% refund.

7. Weather, Safety & Rescheduling

Your safety is our priority. If, in the reasonable judgement of the Captain, weather or sea conditions are unsafe (for example wind above 6 Beaufort or high waves), we will offer to reschedule your Charter to another available date free of charge, or provide a full (100%) refund. The Captain makes the final call on the morning of the Charter.

If you wish to change the date or time of a Charter, we will do our best to accommodate a reschedule subject to availability. Reschedule requests should be made as early as possible and are not guaranteed.

8. What is Included

Unless stated otherwise at booking, every Charter includes:

  • A professional, qualified Captain
  • Fuel for the agreed route and duration
  • Snorkeling equipment
  • Life jackets and safety equipment
  • A pre-departure safety briefing

Routes and points of interest (such as Cape Greco, Konnos Bay, the Blue Lagoon and the Protaras coastline) are indicative and remain at the Captain's discretion based on conditions on the day.

9. Check-in, Late Arrival & No-Show

Please arrive at Ayia Napa Marina at least 15 minutes before your scheduled start time. The Charter duration is counted from the scheduled start time. Late arrival does not extend the Charter and may shorten it, as we operate to a fixed daily schedule.

Failure to attend the Charter without prior cancellation (a "no-show") is treated as a cancellation by the Client and no refund beyond the statutory minimum (if any) is due.

10. Conduct on Board

The Captain has full authority over the Vessel, the route and all matters of safety, and their instructions must be followed at all times. For everyone's safety, the following apply:

  • No illegal substances may be brought on board.
  • Guests must not endanger themselves, other guests, the crew or the Vessel.
  • The Captain may refuse boarding to, or require the disembarkation of, any guest who is intoxicated, behaves dangerously or fails to follow safety instructions — without refund.
  • Smoking, where permitted, is only allowed in designated areas at the Captain's discretion.

11. Health, Safety & Children

Guests should be in reasonable health to participate. Please inform us in advance of any medical condition, mobility limitation, pregnancy or other circumstance that may affect participation, so we can advise whether the Charter is suitable.

Children are welcome but remain the sole responsibility of their parents or guardians at all times. Guests participate in swimming, snorkeling and water activities at their own risk and only with the Captain's approval.

12. Liability

We operate every Charter with reasonable skill and care and maintain the insurance required by law for the operation of the Vessel. To the fullest extent permitted by Cypriot law, we are not liable for:

  • loss, injury or damage caused by a guest's own actions or failure to follow the Captain's instructions;
  • loss of or damage to personal belongings brought on board;
  • indirect or consequential losses; or
  • delays, changes or cancellations caused by events beyond our reasonable control (see Section 14).

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited or excluded under applicable law.

13. Personal Belongings & Damage

You are responsible for your personal belongings at all times. We recommend leaving valuables ashore. The Client is responsible for any loss or damage to the Vessel or its equipment caused intentionally or through the negligence or misuse of the Client or any guest in the Party, and agrees to reimburse the reasonable cost of repair or replacement.

14. Force Majeure

We are not responsible for any failure or delay in performing our obligations caused by events beyond our reasonable control, including but not limited to severe weather, sea conditions, port or marina closures, mechanical failure, strikes, acts of authority, pandemic-related restrictions or natural disasters. Where a Charter cannot proceed for such reasons, we will offer a reschedule or a refund in accordance with Section 7.

15. Photography & Media

We may occasionally take photographs or video on board for promotional purposes. If you do not wish to appear in such material, please tell the Captain or contact us in advance and we will respect your request.

16. Privacy & Data Protection

We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and our Privacy Policy, which forms part of these Terms. Please see our Privacy Policy for full details.

17. Complaints & Dispute Resolution

If something is not right, please tell the Captain immediately so we have the opportunity to put it right, and contact us afterwards at support@blueescapeyachts.com. As a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute-resolution proceedings before a consumer arbitration board but will always try to resolve disputes amicably.

18. Governing Law & Jurisdiction

These Terms and any Charter are governed by the laws of the Republic of Cyprus. The courts of Cyprus shall have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

19. Changes to these Terms

We may update these Terms from time to time. The version in force at the time of your booking applies to your Charter. The current version is always available on this page.
